Brian K. Duncan is a leading attorney based in Sunbury, Ohio with over a decade of experience. Attorney Duncan founded BKD Legal, LLC in 2017 on the pillars of loyalty, justice, and change. There, he and his team offer individuals and businesses throughout the state of Ohio aggressive and personable representation in a range of matters, including business and real estate law, estate planning, insurance law, and civil actions. A champion of civil and individual rights, Attorney Duncan is currently representing former Ohio State University football players including Detroit Lions and Ohio State University linebacker in the federal court case Chris Spielman v. IMG College and Ohio State University which questions the rights of universities to use the likenesses of their former players in for-profit ventures without players’ participation.
Though today Mr. Duncan is a renowned Ohio lawyer, his entry into law traces back to unexpected beginnings. Born and raised in the steel town of Mingo Junction, Ohio, he was a psychology and business student at Washington and Jefferson College when a friend’s invitation to a professional football game changed the course of his career forever. As he tells it:
One night during my senior year of college, I was invited to go to a Cleveland Browns game by my friend who was a law clerk for a Cleveland law firm. That night I met a lot of attorneys and judges in the luxury box and on my way home I told my sister that I was going to go to law school. The next day I signed up for the LSAT and the rest is history.”
After earning his Juris Doctor from Capital University Law School in 2006, Mr. Duncan gained experience in complex real estate and business transactions at a number of local firms. In 2017, Mr. Duncan founded BKD Legal on the belief that America’s legal system should work to protect the rights of the average person, and should change and grow with the people while remaining loyal to their original legal intent. Whether a client is seeking assistance with an injury, issues with a lender, or victimization by an insurance company, he fights tirelessly to make sure that even the most powerful of corporations take responsibility for their actions.
Dedicated to standing up for the rights of his clients, regardless of the specific nature of their case, Mr. Duncan also has years of experience handling transactions for business clients that include Joseph Company International, Inc. He understands that businesses, along with individuals, can be taken advantage of, and he will do everything in his power to ensure that all of his clients—individuals, businesses, and real estate agencies alike—receive competent, credible, and professional legal assistance.
As a leader in his field, Mr. Duncan is grateful to the mentors he had throughout the early years of his legal education. To that end, when time allows, he encourages law students and clerks to come into his office to learn more about the law. In addition to offering mentees his insight on legal best practices, he also notes the importance of staying educated if lawyers are to be a driving force in the law’s evolution:
I am constantly going through current case law that is derived from the Ohio court system and courts nationwide and seeing how it can be changed. The law is always evolving and one thing I have never been afraid of is taking on cases and applying the fundamentals of the Constitution to establish new law. I try to stay one step ahead of the curve and I’ve been fortunate enough to establish precedent in quite a few areas.”
With more than a decade dedicated to shaping the course of legal developments and helping clients to navigate the complex legal world, Mr. Duncan looks forward to continuing to develop his firm alongside his tightknit group of attorneys. Proud of his Ohio roots, Mr. Duncan likes to give back to his community in every way possible.
